Artcards.cc 2010 Pinta Art Fair Contest

OFFICIAL RULES

The following Artcards.cc 2010 Pinta Art Fair Contest (hereafter "the Promotion") shall be construed and evaluated according to the internal laws of the State of Nevada, and, where applicable, the federal laws of the United States.

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED BY LAW. ALL FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS APPLY. Artcards.cc reserves the right, at its sole discretion, to suspend or terminate any portion of the ARTCARDS.CC 2010 PINTA ART FAIR CONTEST.

1. Eligibility:

Open to legal worldwide residents (excluding any jurisdiction where contest would be prohibited by law) residing in the 48 Continental United States who are 18 years of age or older at time of entry. VOID WHERE PROHIBITED BY LAW, INCLUDING, BUT NOT LIMITED TO, ALASKA, HAWAII, PUERTO RICO, U.S. VIRGIN ISLANDS, U.S. MILITARY INSTALLATIONS LOCATED IN FOREIGN COUNTRIES. All federal, state, municipal, provincial and local laws and regulations apply. Employees, former employees, members, directors, shareholders, officers, contractors, dealers, agents and assigns of Artcards.cc, including their subsidiaries and affiliated companies, distributors, participating retailers, advertising, fulfillment, and promotion agencies, and their immediate family members and those living in their same households, are not eligible. Sweepstakes begins at 12:01 a.m. Eastern Standard Time on February 12, 2010 and concludes at 11:59 p.m. Eastern Standard Time on February 25, 2010 (hereafter "the Registration Period").

2. How to Enter:

Artcards.cc has developed a contest page at http://www.artcards.cc/contests/ which allows participants to sign up for the Artcards.cc e-mail newsletter and enter the Promotion for a chance to win the Grand Prize or Second Prize stated below. All participants who subscribe to the Artcards.cc e-mail newsletter via the contest page will receive one (1) chance to win. The Official Rules will be posted online at the Artcards.cc website throughout the duration of the Promotion. Entrants further agree to be bound by the decisions of the judges, which are final and binding in all respects.

All participants must provide their real first and last name, e-mail address and date of birth. Participants may also be asked to answer optional questions; however, they need not be answered in order to be eligible for the Grand Prize or Second Prize. Only online submissions will be eligible. MULTIPLE ENTRIES AND MECHANICALLY REPRODUCED COPIES WILL BE DISQUALIFIED. If a contest participant submits more than one entry, only that contestant’s first (1st) entry will be considered for the Grand Prize or Second Prize. Chances to win are attributed only for successful registrations that occur between 12:01 a.m. Eastern Standard Time on October 30, 2010 and 11:59 a.m. Eastern Standard Time on November 5, 2010. Unintelligible or incomplete entries will be disqualified. No automated entries (including but not limited to entries made using any script, bot, macro or sweepstakes service), or mechanical reproductions will be accepted.

Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries must be submitted by the actual contest participant. All entries become the property of Artcards.cc and will not be returned to the contest participant. If the winning entry is an Internet or other computer entry, the potential winner may be requested to provide proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.

Artcards.cc is not responsible for late, lost, incomplete, or misdirected entries; computer system, phone line, electronic equipment, computer hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature or for problems downloading entries from the website or for any other technical problems related to website entries. Artcards.cc is not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the contest, or by any technical or human error which may occur in the processing of the entries in the contest.

Artcards.cc reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the website; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

3. Winner Selection:

Winners will be chosen at random from entries that were submitted during the Registration Period.

Seven (7) grand prize winners will be selected.

All drawings and selections will be conducted by Artcards.cc or its designee, the judges of the contest, whose decisions are final on all matters relating to the contest. Odds of winning the contest depend on the total number of eligible entries received. The winning participants will be notified by e-mail. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the authorized account holder of the e-mail address, as defined above.

The winning participant will be required to reply from the winning e-mail addresses within one (1) calendar day of notification or their rights to the Prize, or any portion thereof, will be forfeited.

Return of any prize or prize notification as undeliverable will result in forfeiture of the Prize. Winning participants who have given any false information on their registration forms or have violated the Official Rules governing the Promotion will forfeit their prizes.

4. Prizes:

The Grand Prize is two (2) tickets to Pinta New York 2010 Art Fair.

No substitutions in prizes will be allowed except as authorized by Artcards.cc, who may substitute a prize (or portion thereof) with one of comparable or greater value. The winner or winners of the Grand Prize or Second Prize is and are responsible for the payment of taxes on the Grand Prize or Second Prize and for any other costs and expenses associated with the acceptance and use of a Grand Prize or Second Prize. The Grand Prize and each Second Prize is awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) by Artcards.cc. Any required tax reporting forms will be furnished to the United States Internal Revenue Service (IRS).


5. Miscellaneous:

Artcards.cc reserves the right, in its sole discretion, to modify, suspend or terminate the contest should virus, bugs or other causes beyond its control corrupt the administration, security or proper play of the Promotion. Artcards.cc and its affiliates and their respective employees, shareholders, officers, directors, members, agents and assigns, and their respective agencies, personnel, subsidiaries and any other company associated (collectively, the "Released Parties") with this program are not responsible for late, undeliverable, misdirected, or for any computer, on-line, telephone or technical malfunctions that may occur.

By entering, participants, agree (a) to be bound by the Official Rules of the Promotion and the decisions of the judges; (b) to release Artcards.cc and their respective employees and agents from any and all liability, loss, damage or injury resulting from participation in this contest or awarding, receipt, possession use and/or misuse of any prize awarded herein and acknowledges that Artcards.cc, and their respective employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize including, but not limited to, its quality, mechanical condition or fitness for a particular purpose; (c) to grant, except where legally prohibited, and to confirm that grant in writing, upon request, to Artcards.cc and those acting under their authority, the right to use his/her name, photograph, voice and/or likeness in perpetuity for advertising, publicity or promotional purposes in connection with this contest without additional notice or compensation, by Artcards.cc; and (d) to submit to a reasonable investigation by Artcards.cc, including but not limited to a polygraph examination, if, in the sole judgment of Artcards.cc, such an examination is warranted by the facts.

All prizes have been furnished for promotional or advertising consideration and will be awarded in "As Is" condition. Contest winners may be required to complete, sign and return an Affidavit of Winner and liability release and where lawful, publicity releases within one (10) days of notification. If documents are not returned timely or if any prize notification or prize is returned as non-deliverable, the Grand Prize or Second Prize will be forfeited. Decisions by Artcards.cc on all matters relating to the Promotion are final. Grand Prize and Second Prize winners will be responsible for all applicable taxes on the prize and are subject to federal, state and local laws and regulations.

6. Limitations of Liability:

The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the Promotion, or any technical or human error which may occur in the processing of submissions in the Promotion. The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Artcards.cc is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of e-mail on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Promotion. If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Artcards.cc which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, then Artcards.cc reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion.

CONSUMER DISCLOSURE: NO PURCHASE OR OBLIGATION NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

You have not yet won the ARTCARDS.CC 2010 NYC PINTA ART FAIR CONTEST. The actual odds of winning any prize will depend upon the total number of eligible entries received for the Contest. All entries must be received by as indicated above to be eligible for a prize. Contest ends November 5, 2010. See Official Rules above for complete prize restrictions.
